Begin with the actual activity
Federal firearms licensing is tied to the activity a person or business conducts. Importing, manufacturing, or dealing as a business raises licensing questions under federal law. Describe the proposed operation, locations, participants, and transactions accurately before selecting a license type or assuming no license is needed.
Separate collecting from dealing
A collector may obtain a federal license for qualifying curios or relics, but that license is not a dealer's license. It does not authorize engaging in a firearms-dealing business. Whether particular activity constitutes engaging in the business requires attention to the facts and current law; a simple transaction-count shortcut may be misleading.
Review requirements before applying
ATF's current application materials explain license types, application steps, and review procedures. Identify the correct applicant, premises, and responsible persons, and examine applicable eligibility and operational requirements. A federal license does not replace state and local rules, zoning requirements, or other permissions that may apply.
Plan for ongoing compliance
For an operating licensee, compliance is an ongoing process involving the applicable recordkeeping, acquisition and disposition, transfer, identification, background-check, and reporting rules. Requirements and exceptions depend on the activity and transaction. Use current ATF materials and obtain advice about the business's actual procedures rather than relying on a generalized checklist.
Address a notice with the full record
Keep inspection communications, requests, denials, and other notices intact, with relevant dates. Identify the licenses and locations involved and the immediate question.
